Assam Rifles Promotion, Seniority & APAR Disputes: Recruitment Rules, DPC, Benchmark, Review DPC and Retrospective Benefits
Promotion disputes in Assam Rifles are governed by the applicable cadre Recruitment Rules, seniority principles, eligibility conditions, APAR record, vigilance/disciplinary status and the procedure followed by the DPC or other selection authority.

1. Fix the vacancy and rule date
Promotion eligibility may depend on the Recruitment Rules applicable when vacancies arose, when the DPC met or when the panel was prepared. The chronology should record vacancy year, feeder rank, qualifying service, amendment dates and panel date.
2. Seniority disputes
Seniority may be affected by mode of recruitment, date of regular appointment, promotion panel position, quota, rota, merger/restructuring and specific Recruitment Rule provisions. A seniority challenge should identify the exact seniority list and the legal principle said to be violated.
3. Eligibility and qualifying service
Service in the feeder grade, training courses, medical category, educational qualification and other prescribed requirements should be checked against the applicable rules. Administrative instructions cannot ordinarily rewrite a statutory Recruitment Rule.
4. APAR benchmark
Where promotion depends on APAR grading or a prescribed benchmark, the officer should obtain the relevant APARs and communication of adverse or below-benchmark entries where law requires it. A representation against grading should be decided fairly before the grading is used to deny promotion where the governing law so requires.
5. DPC assessment
A DPC is not generally required to write a judgment-like order for each candidate, but the record should show application of the governing criteria. Selection cannot be based on an undisclosed criterion inconsistent with the Recruitment Rules or applicable instructions.
6. Disciplinary proceedings and sealed cover
Where disciplinary or criminal proceedings affect promotion, the precise stage of proceedings and applicable Government instructions matter. A mere complaint or preliminary inquiry is not necessarily equivalent to a formal charge for every service-law consequence.
7. Review DPC
A review DPC may become necessary where the original DPC relied on an incorrect APAR, wrong seniority, an order later set aside, or another material legal error. The relief should identify the corrected record and the vacancy/panel against which reconsideration is sought.
8. Retrospective promotion and consequential benefits
Notional seniority, actual promotion, arrears and pension refixation are distinct remedies. Even where promotion is reconsidered retrospectively, monetary benefits may depend on the reason for earlier non-promotion, availability of vacancy and applicable service-law principles.
9. Medical category and promotion
If medical fitness is a promotional condition, the exact standard and date of assessment should be identified. Medical restrictions should not be applied beyond the Recruitment Rule or authorised policy actually governing the rank.

- vacancy position and roster;
- seniority lists;
- DPC dates and panel;
- APARs and representations;
- disciplinary/vigilance status;
- medical-category record where relevant;
- promotion orders of comparators;
- representation and rejection order.
11. Judicial review
A court ordinarily reviews legality rather than substituting itself for the DPC. Strong grounds include use of the wrong rules, arbitrary seniority, reliance on legally unusable APAR material, discrimination, failure to consider a binding representation decision or denial of review DPC after the foundation of the original decision has disappeared.
12. Conclusion
Promotion litigation should be vacancy-specific and rule-specific. A precise chart of eligibility, seniority, APARs, DPC action and comparator treatment is more effective than a general plea that the member was “due” for promotion.
