Assam Rifles Resignation Before Completion of Service: Rule 27, Competent Authority, Training Cost Refund and Refusal
Resignation from Assam Rifles before completing the term of engagement is not automatically effective on submission. Rule 27 creates a permission-based statutory process and identifies the authorities competent to deal with officers, subordinate officers and enrolled persons.

1. Rule 27 for officers
The Central Government may, having regard to the special circumstances of a case, permit an officer to resign before completing the term of engagement. The Rule therefore contemplates consideration of individual circumstances rather than automatic release.
2. Refund condition
Before permission is granted, Rule 27 permits the Central Government to require refund of three months’ pay and allowances or the cost of training imparted, whichever is higher. Any demand should identify the legal basis, amount and calculation rather than state a bare figure.
3. Effective date
The competent authority may accept resignation with effect from the date it considers expedient. Until acceptance and lawful release, the member remains subject to service obligations. Leaving merely because an application has been submitted can create separate disciplinary consequences.
4. Grounds on which resignation may be refused
Rule 27 permits refusal in the circumstances specified by the Rule, including declared emergency, discipline of the Force and an unexpired specific undertaking to serve for a stipulated period. The refusal should be traceable to the statutory ground actually relied upon.
5. Subordinate officers and enrolled persons
Rule 27 extends the resignation framework to subordinate officers and enrolled persons while allocating the Central Government’s powers to different authorities according to rank. The applicant should therefore verify the competence of the authority passing the order.
6. Resignation versus retirement or discharge
Resignation is legally distinct from compulsory retirement, medical discharge and release on unsuitability. Pension, gratuity, continuity and other service consequences can differ materially depending on the route. The terminology used in the final order matters.
7. Pending disciplinary proceedings
Where disciplinary proceedings or a serious investigation are pending, the authority may consider the effect on discipline under Rule 27 and other applicable provisions. The member should avoid assuming that resignation automatically terminates disciplinary jurisdiction.

- engagement/enrolment terms;
- bond or service undertaking;
- resignation application and reasons;
- proof of receipt;
- training-cost calculation if demanded;
- recommendations and competent-authority order;
- relieving certificate and service book;
- pension/NPS/other retirement-benefit papers.
9. Judicial review
Where refusal or conditions are challenged, judicial review ordinarily examines competence, adherence to Rule 27, relevant considerations, equality, arbitrariness and reasons apparent from the record. The relief depends on the factual and service context; the court does not ordinarily rewrite service terms merely because resignation is personally desirable.
10. Conclusion
A legally sound resignation request should address the term of engagement, reason for early release, competent authority, service undertaking, training-cost issue and desired effective date. Written records are essential because resignation does not take effect by unilateral declaration alone.
