Filing a divorce case at Saket Family Court begins with a jurisdiction analysis, not merely the physical location of the litigant or lawyer. Electronic filing does not cure a jurisdictional defect. The petition must satisfy the applicable matrimonial statute and current court allocation.

For Hindu marriages, Section 19 of the Hindu Marriage Act, 1955 is central. Depending on the facts, jurisdiction may arise from the place where the marriage was solemnised, where the respondent resides, where the parties last resided together, and in circumstances recognised by the section, where the wife resides at the time of presentation.

Jurisdiction warning: “South Delhi”, “Saket”, or a police-district label is not by itself the legal test. The petition should plead the precise statutory fact that gives the chosen Family Court territorial jurisdiction.

1. Identify the type of divorce

The first procedural fork is whether the matter is by mutual consent or contested. A mutual-consent petition under Section 13B HMA is a joint proceeding based on agreement. A contested petition under Section 13 relies on a statutory ground such as cruelty or desertion and proceeds through pleadings, evidence and adjudication.

See the site’s detailed guides on Mutual Consent Divorce at Saket Family Court and Contested Divorce at Saket Family Court.

2. Prepare the petition and jurisdiction facts

A properly drafted petition should state the marriage details, governing law, parties’ addresses, children if any, date and place of marriage, last matrimonial residence, date of separation, jurisdictional facts, pending proceedings, reliefs sought and the material facts supporting each ground.

3. Collect filing documents

  • marriage certificate or proof of marriage;
  • identity and address proof;
  • documents supporting territorial jurisdiction;
  • children’s records if custody or support is involved;
  • income and financial documents for maintenance;
  • documents relied on in contested proceedings;
  • copies of connected DV, maintenance, custody or criminal proceedings;
  • settlement terms in a mutual-consent matter; and
  • supporting affidavits required by current filing practice.

4. E-filing and scrutiny

Delhi District Courts provides electronic filing facilities. Lawyers and litigants should follow the current registration, document-format and filing requirements. Official resource: Delhi District Courts — e-Filing.

After filing, defects concerning documents, affidavits, pagination, party details or jurisdiction may be raised during scrutiny and should be cured promptly.

5. Service, mediation and interim applications

In contested proceedings, valid service is essential. Family Courts also have a statutory settlement role. Depending on the case, parties may seek interim maintenance, litigation expenses, child custody or visitation while the matrimonial proceeding remains pending.

6. Evidence, judgment and appeal

If settlement does not resolve a contested matter, the proceeding advances through pleadings and evidence. At conclusion, the Family Court passes the appropriate judgment or order. Appeal rights depend on the nature of the order and the applicable statutory framework.
