ITBP Leave, Medical Absence & Dies-Non: CCS Leave Rules, FR 17/17-A, EOL, Unauthorized Absence, Pension & Promotion Impact
Leave disputes in ITBP can affect far more than salary for the days of absence. An order treating a period as unauthorized absence, extraordinary leave, dies-non or break in service may alter qualifying service, increments, promotion eligibility, MACP and retirement benefits.

1. No pay for unauthorized absence under FR 17
FR 17 provides, subject to the rules, that a government servant who is absent from duty without authority is not entitled to pay and allowances for that period. The immediate consequence is therefore financial, but the service consequences may go further where FR 17-A or another rule is invoked.
2. FR 17-A and interruption of service
FR 17-A addresses specified periods of unauthorized absence, including an individual employee remaining absent without authority or deserting the post. Such a period may be deemed to cause interruption or break in service for specified purposes unless the competent authority decides otherwise. The employee should therefore insist that the final order identify whether FR 17-A is being invoked and for what consequences.
3. Medical absence is document-sensitive
An employee who is genuinely ill should preserve contemporaneous medical certificates, admission/discharge records, prescriptions, referrals, communications to the unit and applications for extension of leave. A later medical certificate may not cure failure to communicate absence, but the authority must still examine genuine medical evidence before characterising the entire period as wilful unauthorized absence.
4. Extraordinary leave is not automatically misconduct
Extraordinary leave may be granted in circumstances recognised by the leave rules, often when no other leave is admissible or when the employee seeks such leave. Whether EOL counts for increment, pension or other service benefits depends on the applicable rule and the reason for which it was granted. It should not be casually equated with punishment.
5. Work Related Illness and Injury Leave
The CCS Leave Rules were amended to introduce Work Related Illness and Injury Leave (WRIIL) for illness or injury attributable to or aggravated by official duties or official position. In an ITBP context, where injury occurs during operational, training or other official duty, the medical and occurrence records should be preserved because the character of leave can affect both pay and later disability-related claims.
6. Dies-non consequences should be expressly reasoned
A dies-non order can have consequences for service continuity and benefits. The authority should state the precise period, rule, reason and treatment for pay, increment, qualifying service and other benefits. An employee cannot effectively challenge an order that uses a label without explaining its legal effect.
7. Interaction with disciplinary proceedings
Unauthorized absence may separately constitute an offence or disciplinary misconduct under the ITBP statutory framework. Regularisation of the absence for leave-account purposes does not necessarily erase disciplinary liability, and disciplinary punishment does not itself determine how the leave period must be treated. The two questions should be decided under their respective legal provisions.
8. Promotion, MACP and pension impact
Long periods excluded from qualifying service can affect the date on which an employee completes required service for promotion, MACP or retirement benefits. A successful challenge to the treatment of absence may therefore require consequential recalculation of seniority eligibility, financial upgradation and pension.

10. FAQs
Does every unauthorized absence break ITBP service?
No. The precise legal consequence depends on the applicable rule, the order passed by the competent authority and the facts of the absence.
Can medical evidence justify absence?
It can be highly relevant, but the authority will also examine whether leave was sought, whether the unit was informed and whether the medical material is reliable and contemporaneous.
Can dies-non affect pension?
Yes, depending on how the period is treated for qualifying-service purposes under the applicable pension framework.
