Netherlands–India NRI Divorce in Delhi: Dutch Divorce Decree, Hague Service, Euro Income, Maintenance & Child Custody Guide 2026
A detailed cross-border guide for Indian marriages involving a spouse in the Netherlands, Dutch matrimonial proceedings, euro income, business interests, children living abroad or parallel Delhi litigation.
Netherlands–India matrimonial disputes are governed in India by the applicable matrimonial statute or personal law. The overseas element affects procedure, foreign-decree recognition, service, financial disclosure, child relocation and settlement. A Dutch decree that is final in the Netherlands is not automatically conclusive in India if marital status is disputed here.
Delhi jurisdiction where a spouse lives in the Netherlands
For HMA marriages, Section 19 should be pleaded with precision. Place of marriage, residence of the respondent, last matrimonial residence and other statutory connecting factors should be supported by documents. A petitioner should prepare a migration chronology showing when the couple left India, where they last lived together and when Dutch residence began.
Recognition of a Dutch divorce decree
Section 13 CPC remains central. The Indian court may examine the foreign court’s jurisdiction, merits, natural justice, fraud, applicable law and whether the foreign claim can be recognised consistently with Indian law. Y. Narasimha Rao remains the leading matrimonial authority.
Preserve the Dutch petition, service documents, response, hearing record, consent or settlement papers, final judgment and proof of finality. Where documents are in Dutch, reliable translations may be required. If the Indian spouse appeared only to challenge jurisdiction, that limited participation should be clearly documented rather than later treated as unconditional submission.

Serving a spouse in the Netherlands
India and the Netherlands are Contracting Parties to the 1965 HCCH Service Convention. Formal service should be undertaken consistently with the Delhi court’s directions, the Convention and the Netherlands’ current declarations. A complete Dutch residential address and postal code should be provided; stale addresses are a common source of delay.

Euro salary, bonus and maintenance
A maintenance case should separate gross and net salary, tax, pension and social deductions, bonus, equity compensation, housing, childcare and genuine recurring liabilities. For highly paid professionals, annual compensation may include restricted shares, deferred incentive or variable pay that should be distinguished from cash already received.

Property, shares and business interests
Cross-border wealth does not create an automatic Indian 50:50 matrimonial property division. Title, ownership, corporate rights, the relief pleaded and applicable Indian law matter. Settlement can voluntarily address identified shares, property or investments, but litigation should avoid importing a foreign asset-sharing assumption without an Indian legal basis.
Child custody and Netherlands–India relocation
Child welfare remains paramount. A relocation dispute may require analysis of school continuity, caregiving history, medical needs, immigration position, linguistic environment, emotional ties and the practical ability of the non-relocating parent to retain meaningful contact.

Parallel Dutch and Delhi proceedings
Preserve all foreign pleadings, service material and interim orders. Statements on residence, separation, finances and children should be consistent across jurisdictions. Participation in a Dutch proceeding may later be relevant to Indian recognition.
