Saket Family Court can be relevant to an NRI divorce where the applicable statutory jurisdictional facts connect the matrimonial proceeding with the South or South-East Delhi court system. The court location itself does not create jurisdiction; the petition must satisfy the governing statute.
Section 19 HMA and Saket jurisdiction
For Hindu marriages, Section 19 HMA refers to the place of marriage, residence of the respondent, last matrimonial residence, the wife’s residence in specified circumstances, and the petitioner’s residence where the respondent is outside the territories to which the Act extends. The pleading should identify the exact limb relied upon and the facts connecting it with the competent Delhi district.
Overseas respondent and service
Where the respondent lives outside India, the petition should provide a complete foreign address and all known service particulars. Formal service may require Hague Convention or Ministry channels depending on the destination. Court directions should be obtained before relying on electronic modes alone.
Foreign divorce decree raised at Saket
If a party relies on a foreign decree, the Indian court may have to examine its conclusiveness under Section 13 CPC. The Supreme Court’s Y. Narasimha Rao principles remain central to foreign matrimonial judgments. A consensual foreign decree, a contested decree and an ex parte no-fault decree may present very different recognition questions.
Maintenance and foreign income

Delhi District Courts currently states that e-filing is available for Family Courts across all Delhi districts. E-filing is a filing mechanism; it does not cure jurisdiction, service or evidentiary defects.
