Switzerland–India matrimonial disputes often involve high professional incomes, international banking or investment records, multilingual foreign documents and children whose schooling or residence is centred in Europe. Indian courts do not apply a separate “Swiss NRI divorce law”; they apply the matrimonial law governing the marriage and Indian rules on jurisdiction, recognition, evidence, maintenance and custody.
When can a Switzerland-connected divorce be filed in Delhi?
For marriages under the Hindu Marriage Act, Section 19 supplies the main territorial framework. Pleadings should identify the precise statutory basis and document the place of marriage, last shared residence, current addresses and migration chronology. Foreign residence should be described factually rather than used as a substitute for jurisdictional pleading.
Swiss divorce decree and Indian recognition
