A high-net-worth divorce in Malviya Nagar is not governed by a separate matrimonial statute. In an HNI dispute, a spouse may be a promoter, director, partner, consultant, doctor, lawyer, architect, investor or entrepreneur. Economic capacity may therefore be spread across several entities and asset classes.

Depending on the facts, relevant material may include company shareholding records, partnership deeds, audited financial statements, capital accounts, director remuneration, dividend history, loan accounts, related-party transactions, rental income, securities, demat statements, property records, trust-related material where legally relevant, and overseas income records.

Business assets and company shares

A company’s assets are not automatically the personal assets of a shareholder merely because a spouse controls or owns shares in the company. At the same time, shareholding, remuneration, dividends and economic benefits can be relevant to financial capacity, settlement negotiations and maintenance analysis.

Questions that frequently arise include whether shares are individually held or jointly held, whether they were acquired before or during marriage, whether family members hold interests, whether there are shareholder restrictions, whether a business can realistically generate liquidity, and whether a settlement should involve cash, property, staged payment or another lawful structure rather than operational interference with the business.

Real estate and the matrimonial home

South Delhi HNI disputes often involve self-acquired property, jointly purchased property, parental property, rented residences, investment property or property held through entities. A residence claim under the Domestic Violence Act is analytically different from a title claim. Likewise, ownership documents do not by themselves answer every shared-household question.

Where property is jointly owned, the parties may need to decide whether it will be retained, sold, transferred, occupied for a defined period or addressed separately through appropriate property remedies. Where the property belongs to parents or another third party, their legal rights and title cannot simply be ignored because the property was used as a matrimonial residence.

Maintenance and alimony in a high-income case

Sections 24 and 25 of the Hindu Marriage Act, Section 144 BNSS and Section 20 of the Domestic Violence Act may become relevant depending on the proceeding and relief claimed. The Supreme Court’s framework in Rajnesh v. Neha, (2021) 2 SCC 324 makes financial disclosure central to maintenance litigation and requires overlapping maintenance proceedings and orders to be disclosed.

In an HNI dispute, the court may need to distinguish turnover from income, company wealth from personal wealth, gross receipts from disposable income, and lifestyle expenditure from legally available resources. A high business turnover does not automatically equal personal monthly income; equally, a nominal salary may not reveal the full economic benefits available to a promoter or partner.

Child custody, schooling and lifestyle expenses

High-net-worth parenting disputes can involve premium school fees, international curricula, tutors, medical insurance, extracurricular activities, overseas travel and relocation. The controlling principle remains the welfare of the child, not the financial status of either parent.
